NEED A WILL URGENTLY?
There are some situations when a Will is needed to be prepared extremely quickly, maybe even the same day instructions are received.
In my experience, the most common circumstances when an Emergency Will has to be prepared is when the testator (the person preparing the Will), needs to go into hospital for an operation, or in the event of a serious illness.
There is no reason why a Will cannot be written within a few hours and signed that same day, particularly when this is a simple Will.
As a solicitor taking instructions however, we must always be satisfied that the testator has, what is called testamentary capacity to make their Will, and that they are not being pressurised in any shape or form.
We at Premier Wills and Estate Planning are equipped to deal with any emergency situations, and can write a Will and see to its execution very quickly. We will visit you in your home or in the hospital if need be.
Dependent on the circumstances and the level of urgency, this Will may not allow time for proper tax planning or advice. As such it should be considered an interim Will. If it is being written as a deathbed Will, then thought should be given to the prospects of it being challenged. We will provide you with information about the risks of excluding people from your Will that may be considered to be entitled.
